Terms of Use

These Terms of Use ("Terms") govern your access to and use of pixelOS websites, applications, and services (collectively, the "Services"). By using pixelOS, you agree to these Terms.

If you do not agree, do not use the Services.

1. Eligibility and Account Responsibility

pixelOS is intended to be set up and managed by a parent or legal guardian. You represent that:

• You are legally able to enter into this agreement
• Information you provide is accurate and current
• You are responsible for account activity under your credentials

You must keep login credentials secure and promptly notify us of suspected unauthorized use.

2. Parent-Managed Child Use

pixelOS is designed for children in a parent-managed experience. Parents or legal guardians are responsible for:

• Determining whether the Services are appropriate for their child
• Configuring child profile and safety settings
• Supervising use as needed based on their child's age and maturity

3. License and Permitted Use

Subject to these Terms, pixelOS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial family use.

You may not:

• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law
• Interfere with platform security, integrity, or availability
• Use automated means to scrape, overload, or abuse the Services
• Use the Services to create unlawful, harmful, or infringing material
• Resell, lease, or commercially exploit the Services without written permission

4. User Content and Prompts

You may provide prompts, text, and other inputs, and receive generated outputs (collectively, "User Content").

You are responsible for User Content you submit or direct through your account, including ensuring it does not violate law or these Terms.

As between you and pixelOS, and subject to applicable law, you retain rights you hold in your User Content. You grant pixelOS a limited license to host, process, and display User Content as needed to operate and improve the Services, enforce safety systems, and comply with law.

5. AI Features and Output Limitations

pixelOS uses AI systems to generate outputs. AI outputs may be incomplete, inaccurate, or unsuitable for a specific purpose.

You acknowledge and agree that:

• AI output should be reviewed by a parent or guardian before reliance
• Outputs may resemble content seen elsewhere
• pixelOS does not guarantee factual correctness or fitness for any specific purpose

6. Safety, Moderation, and Enforcement

To protect users and platform integrity, pixelOS may apply content filtering, guardrails, and moderation controls.

We may suspend, restrict, or terminate access, or remove content, if we reasonably believe there is:

• A violation of these Terms
• Safety risk, abuse, or unlawful behavior
• Security threat or misuse of platform resources

7. Fees, Trials, and Billing

If paid plans are offered, pricing and billing terms will be presented at checkout or in-product. Unless stated otherwise:

• Charges are in U.S. dollars
• Subscription renewals occur automatically until canceled
• You may cancel renewal according to your subscription settings

Except as required by law, fees already paid are non-refundable.

8. Intellectual Property

The Services, including software, branding, design, and underlying technology, are owned by pixelOS or its licensors and are protected by intellectual property laws.

No rights are granted except as expressly stated in these Terms.

9. Third-Party Services

The Services may rely on or link to third-party services. pixelOS is not responsible for third-party content, policies, or practices.

Your use of third-party services is subject to their terms and policies.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

pixelOS does not warrant uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, pixelOS and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising out of or related to use of the Services.

To the maximum extent permitted by law, pixelOS's aggregate liability for claims related to the Services will not exceed the greater of (a) amounts paid by you to pixelOS in the 12 months before the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless pixelOS and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your misuse of the Services
• Your violation of these Terms
• Your infringement of another party's rights through User Content or account activity

13. Termination

You may stop using the Services at any time. We may suspend or terminate access at any time, with or without notice, for reasons including security, legal compliance, or violations of these Terms.

Upon termination, provisions that by nature should survive will survive, including ownership, disclaimers, liability limitations, indemnity, and dispute terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.

Any dispute arising under these Terms will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts, unless applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and may provide additional notice.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
